ZERONA MODEL SEARCH CONTEST RULES

Notice To Contestants: This contest is sponsored solely by Erchonia Corp. Facebook is not affiliated with this contest. By submitting an application to Erchonia, you agree to release Facebook from any and all claims or liability of any kind arising out of or related to this contest.

• Application Deadline: December 31, 2011. Applications should be submitted through Zerona’s Facebook Page or through the Zerona website, www.myzerona.com. Applications may also be sent to Erchonia by U.S. Mail at the address listed below. Applications must include your name, address, telephone number, email address, before and after photographs, the name of the healthcare practice where you were treated with the Zerona procedure, the number of inches lost by use of the Zerona procedure, and a statement of how the procedure affected you and why you deserve to win the contest. Any incomplete applications may be disregarded. Winners of the contest will be announced on the Zerona website no later than.
• All contestants must be over 18 years of age and legal residents of the United States.
• All contestants must have received Zerona treatments from an authorized healthcare professional in accordance with the applicable protocols in order to be eligible.
• No purchase is necessary to enter the contest, nor is any contestant required to pay any fee in order to enter the contest.
• Contestants must not have had any other cosmetic procedures other than Zerona treatments. Contestants must disclose all cosmetic procedures they have received to Erchonia.
• Contestants must meet eligibility requirements in order to receive any prizes for participation in the contest.
• Contestants must submit photographs showing their condition immediately prior to receiving Zerona treatments and promptly after receiving Zerona treatments. Photographs cannot be edited or retouched in any manner and must fairly and accurately show contestant’s condition prior to and after receiving the Zerona procedure.
• All photographs, written materials, application forms and any other materials submitted by any contestant to Erchonia become the property of Erchonia. No materials submitted to Erchonia will be returned. In addition, you authorize Erchonia to make any use of such materials it deems appropriate, including the right to copy, reproduce, duplicate, edit, distribute, publish or otherwise disseminate the materials or any copy of such materials. By submitting the entry materials you represent and warrant that: the materials are your own original materials; that these materials have not been previously published anywhere; you have the full right and authority to use and submit these materials; that the materials do not infringe upon the copyright, trademarks, right of privacy or publicity or any other rights of any third party; that the materials do not contain any defamatory, obscene or illegal content; and that you agree to be bound by these rules and any other terms applicable to this contest.
• All contestants grant Erchonia the right to use their name, image, voice, likeness and signature, in any Erchonia advertising or promotional activities. By participating in the contest you release any and all claims you may have against Erchonia based on Erchonia’s use at any time in the future of your name, image, voice, likeness and signature.
• Winners will be selected based upon the decision of the judges appointed by Erchonia, using such criteria as Erchonia and the judges shall determine. The decision of the judges shall be final.
• A list of the contest winners may be obtained by sending a self-addressed prepaid envelope to Erchonia at the address listed below and requesting the list of contest winners.
• Any dispute regarding: eligibility of any contestant; the selection of the winners of the contest; or any other dispute regarding the contest shall be decided by Erchonia in its sole discretion. The decisions of Erchonia shall be final.
• Winners acknowledge and agree that they will need to execute such further documents as Erchonia may require in order to receive any awards or prizes.
• If the specified prizes become unavailable due to unforeseen circumstances, Erchonia may substitute another prize of like or equal value.
• Contestants may be liable for payment of taxes on any prizes they receive. Contestants are advised to talk to their own tax advisor regarding the tax implications of any prizes they may receive.
• Employees of Erchonia or any of its affiliates are not eligible for the contest.
• Void where prohibited by law.
• Erchonia may revise these rules at any time. Any revised rules will be published on this website or may also be obtained at no cost from Erchonia.
• This contest is governed by Texas law.
• Definitions:
  • “Erchonia” refers to Erchonia Corp. the sponsor of the contest.
  • “contestant” refers to any person who participates in the contest.
  • “winner” shall mean an person selected by the judges as a winner of the contest.
